What is No Win, No Fee?

Most No Win, No Fee arrangements are just as it says “No Win, No Fee”. These are cases where you do not have to pay any solicitors’ fees should you be unsuccessful in your claim.

Why Make A Claim?

There are a few advantages to making a claim including:

  • - Obtaining rightful compensation for pain and suffering
  • - Receiving treatment or therapy to help with recovery
  • - Recovering “out of pocket” expenses and costs such as medication, physiotherapy etc
  • - Lost earnings can be recovered if you are unable to work or had to work less hours
  • - Obtaining the cost of care if you are seriously injured

Why Use a Solicitor?

Having a solicitor will help you argue your case with the responsible party’s insurer. This will help to ensure that you receive a fair amount of compensation as settlement.

Solicitors help in negotiating with the insurers on your behalf. They will also assess the value of your claim and who is responsible.

How Much Compensation Is Available?

The amount of compensation available will vary depending on the circumstances of the claim. Most personal injury claims will involve you receiving 100% of the compensation.  Other types of claim may require costs to be paid at a set percentage of the compensation you may receive.

Average compensation awards for soft tissue injuries range between £2000-3000.

Types Of No Win, No Fee Agreement?

There are two types of No Win, No Fee agreement. One is a Conditional Fee Agreement, which is used for Personal Injury claims. Under this if you are successful in your claim the other party or insurance company will pay your bill.

We also offer this type of arrangement for some Litigation matters.

The second type is a Contingency Fee Agreement, which are used for CICA (Criminal Injury), MIB and Employment Litigation. If your claim is successful under this type of arrangement, our fees will be recovered as part of the compensation you may receive. This is usually at a set percentage which may vary depending on the type of claim.

What Cases Are Covered By No Win, No Fee?

We offer No Win, No Fee for Personal Injury, Criminal Injury, Litigation and Employment law matters.

Who Pays The Costs?

If your claim is successful, it is usually the other side or insurer who will pay your costs, under most Conditional Fee Agreements.

This would be different under a Contingency Fee Agreement where your legal costs would be at a set percentage of your compensation should you be successful.

Are There Any Additional Expenses?

It may be that your case needs to go to court. In these circumstances, most common insurance policies have the benefit of legal expenses cover. This would cover the risk of a costs order being made against you in the event that your claim is unsuccessful.

What Happens If A Case Is Unsuccessful?

If your case is unsuccessful you do not have to pay us anything as agreed as part of the No Win, No Fee arrangement.

How Much Would It Cost If No Win, No Fee Is not Available?

We offer legal advice and services in other areas including Family and Wills and Probate.

We do not offer No Win, No Fee for these areas. Costs can vary depending on the circumstances and the type of work that needs to be done.

It may be that some Employment and Litigation cases also do not qualify for No Win, No Fee and an hourly rate would apply.
